After repeated harassments by the Builder, we were successful in getting favourable Order from RERA for refund of amount with interest and now builder is under pressure to settle the same. Booking Details: I have booked a small shop (196 sqft) in E-Square commercial project of Supertech in Sector 96, NOIDA in Feb.2012 and 95% of the total cost (including all taxes) was paid to the Builder by 17.12.2014.
As per the allotment letter, possession of the Unit was due by 01.07.2015, including grace period of six months but the is still awaited.
The Builder is forcing to lease out the shop or settle for alternative project, which is against the agreement entered into by both parties. More than nine years lapsed but no possession in sight. It is a clear cut breach of agreement.
I am a senior citizen of 66 years old and have invested all my hard earned money for the said unit having no pension or any source of regular income to survive. I am not interested to enter into legal dispute either.
It is, therefore, my humble request to settle the case and refund the paid amount along with interest, as laid down in the agreement in case of default or breach of agreement.
