Dear Sir/Madam,
Supertech Limited is sending illegal demands to buyers as an offer of possession with given due dates whereas Supertech have not produced Completion certification to buyers. Below are the points where Supertech is not providing any documentary evidence but putting them on buyers illegally. Kindly look into this matter seriously as it is effecting buyers mentally and financially.
1. Interest
Supertech has demanded interest on delay payments where they have never communicated this to buyers in last 5 years during construction phase. These demands are based on the due dates as per their construction link plan in the agreement however construction were not made as per given dates but they are asking interest based on these dates. Banks only disburse payments when builder provide them completion certificate as of given floor.
2. Delay penalty
Supertech is calculating delay penalty based on the date of offer of possession not on the actual date of possession.
3. Escalation charges
Supertech somehow included the hidden escalation charges in few buyers’ agreement and when I have given them proof of few of my friends unit where this charges is not applicable. They replied that my tower is different from others. My question is that how the construction cost will be effected for few towers only not for all towers. Was there a special material discount Supertech gets from the market based on their special tower? This is clear indication of fraud and cheating.
4. Differential Area –
When my unit was transferred in Dec 2012 at that time my floor was already built in that case how Supertech can demand such differential area charges post construction. This is a clear indication of cheating.
In the past 5 years, Supertech has never communicated to buyers about such differential area cost during the construction phase Also I have checked with Supertech official last year when I visited the site and they told me that no flat layout change has been done for old buyers
5. Labor Welfare Charges-
Supertech is demanding Labor welfare charges from buyers where it is no where mentioned in the agreement.
