We Booked Flat E-403 Supertech green village Meerut on 14-nov-2010. We want to take loan against payment of our booked flat. But As per Bank requirement we need to give allotment as well as tripartite agreement to bank to avail loan.So we approach supertech authority almost daily asking for allotment letter but they always shows there reluctance in providing the same to us. They provide allotment letter to us on 14-april-2011. But still due to unavailability of Tripartite agreement loan amount delayed. it was made on 15-feb-2012 & therefore amount released by UCO Bank on 12-mar-2012. we submitted all required documents to bank on time but the disbursement of amount made in 13-mar-2012 because proper papers for issuing home loan were made available by Supertech in 14-feb-2012 and during the period we were in continuous touch with the local Supertech Team and they told us we will not penalize for this delay. Our loan was sanctioned 21-nov-2012 we have a copy of it as a proof. Total delay is for 394 days by supertech authority at meerut. Now at the time of possession they charge interest on delay payment which amount to Rs 5, 55, 870/- which is @24%p.a on principal amount that delay.
We approach CRM at noida now they reduce amount to 4, 07, 207/- But still amount 4lac is big amount, it is almost 19% of our flat cost which is 22lac. And also they have written on allotment letter that if there is delay in possession to customer they provide compensation which is Rs4 per Sq Ft on monthly bases. When we told this to CRM at Noida they show a line written on allotment that if timely paid than they Will give compensation. But this delayed was done by supertech authority. So they should also give compensation for delay in possession which amount to Rs 1, 92, 640/-(delay in possession from dec2012 to Aug2015 which is 32month –Rs4*1505*32=1, 92, 640 where 1505 is area of flat in sq ft). I am paying monthly rental as well along with EMI which is huge financial loss to me, If would have got my possession on time, I would have saved my rent + interest to bank & prepay the bank loan. Moreover they are asking Labour charges, advance maintenance charges and other misc charges. Which total cost Rs1, 11, 125. It is not possible for a middle class family to bow down to their high demands of payment which is not appropriate and correct. They are asking for Labour welfare charge from customers which was not mentioned in the allotment letter. Additionally, they are asking for Water connection charges which was also not mentioned in the allotment letter.
-Amount of Rs 19, 26437 we have to pay till 14-jan-2011
-Allotment letter made on 14-april-2011
-Agreement to sale was made on 15-feb-2012
-But already Loan sanctioned on 21-nov-2012 but bank paid to supertech on 12-mar-2012 because o[censored]navailability of tripartite/ agreement to sale which is delayed by supertech authority. (Amount was delayed from 14-jan-2011 to 13-mar-2012)
Therefore a total delay of 394 days six month for providing allotment letter and rest in providing agreement to sales for release of amount from bank to supertech account,
Since the delay was not our part, it is therefore request that we should be exempted from paying interest. We have also supporting document in this regard that we have attached.Following attachment submitted for your kind perusal.
