Sir,
1. That it is the violations to the Consumers rights so the complaint is being made to the District Collector Kapurthala to investigate the matter that how the bill raised to the product which is not in stock and why not the product got delivered till date after the expiry of one week even. The Complaint is being lodged at National Consumer Helpline (NCH)
2. It is a matter of great regret that the Companies Like Vishal Mega Mart despite receiving full and final payment from the customer fail to deliver the item ordered whereas the billing has been made showing that the said item has been delivered whereas on the date of delivery the concerned Delivery Personnel has made me a call that the said Ariel Liquid Detergent which is not in stock will be delivered within 2-3 days but the said item could not be delivered in one week even.
3. As the Company is duty bound to intimate regarding the Delivery Status of the item booked even if it is temporarily out of stock, that your order got screwed up somehow due to certain reasons the item could not be supplied to you. The company is so careless that it failed to make a Phone call to provide the intimation regarding delivery status to the customer.
4. That it means that Vishal Mega Mart is issuing Fake bills that is being deleted that’s why the company is careless about the Delivery Status of the product. Secondly if the product was not in stock then how the billing of the product raised. Thirdly why the company failed to intimate the Delivery Status of the product.
5. That the company is duty bound to confirm that if the product is out of stock then to provide the specific date of delivery of the product to the customer and provide the reasons of non delivery which is beyond their control. AS it is deficiency in Service by the Company So the Legal Notice is being served to the company due to Deficiency in Service and Unfair Trade Practices adopted by Vishal Mega Mart. It is Unfair Trade Practices as to promote its services or sale of its goods supply and distribution of its products Vishal Mega Mart used illicit and illegal means to mislead the general public and opted to generate the Sale invoice to the product which is not in their stock and so the Complaint under Consumer Protection Act is being filed against the company for adopting Unfair trade practices. The company is adopting the procedure to dodge the customers by previously booking the item and after raising the bill to which the advance payment has been received by the company and afterwards on continuous follow up has no other option than to return the payment received and this way adopting Unfair trade practices adopted.
6. This way the Company which is adopting fraudulent and Unfair Trade practices is liable to be a penalty What is unfair trade practices under Consumer Protection Act?
7. The term “unfair trade practice” describes the use of deceptive, fraudulent, or unethical methods to gain business advantage or to cause injury to a consumer. Unfair trade practices are considered unlawful under the Consumer Protection Act.
