Sir,
I am the sole and absolute owner of the property bearing No. 377-D, Shanthiniketan Layout, Arakere, Bannerghatta Road, Bengaluru 560 076 (hereinafter the ‘Schedule Property’). The Schedule Property was developed by M/s Shanthi Builders and was approved by the Bangalore Development Authority and handed over to the BBMP.
The Schedule Property was purchased jointly by my family vide registered sale deed dated 16.11.2005, registered as Document No. 9899/2005-06, Book 1 and stored in CD No. BASD194 at the office of the Sub Registrar, Bengaluru South Taluk. I have been in possession since 2005. The Schedule Property is a corner plot, and is abutted by a road. This is clear from the approved sanction/ layout plan.
Much to my surprise, on 21.09.2021, certain persons said to be representatives/ workmen of Shanthinikethan Area Association and Shanti Builders began to dig up the road. On inquiry, I learnt that they are intending on illegally putting up construction on the public road. I made several attempts to stop the same, to no avail. These workmen have commenced digging of the road.
Needless to say, this is gross violation of the law, as well as the Sanction Plan. These actions are not only in violation of the settled law but are also interfering with my easementary right to light and air, besides encroaching over the road over which I have a vested interest.
In these circumstances, I request to you to kindly take immediate action against the aforementioned illegal encroachments to ensure there is no construction put up in violation of the Sanction Plan.
