[Resolved]  Maxworth Projects / Builders — Cheque bounced / not responding

I had booked a villa in Bhopal under Maxworth Projects and had given them a cheque for Rs 44500. Later some time I asked them for the refund of my money as they were not giving me any registration papers. Now the cheque has bounced which they some how managed to give me. Now when I call their office, all I get to know is that the owner Mr. Amit is not there in the office and the person there (Hemant) will get back to me. I have not yet heard from them on this it's been 1.5 months now.
Pls help.

Hi Rahul and Saya,

I don't think that you had a talk with Mr Amit Rathore as it is confirmed that he is behind the bars. This is again confirmed from the Bhopal Branch Office.

Please advise the amount and date of refund of your money.

The advocates of Amit Rathore, Saya and Rahul are at loss as they tries to spread this message that rathore is a free bird and that he is not a cheat.

Well... truth needs no testimony... rahul and saya stop being a pseudo individuals coz we understand that you are imagination of amit rathore and company just to protect his image...
Saya and Rahul, must say Goddess Lakshmi has smiled on you and hope the same happens to us too. Are you from Bhopal? How did you manage to get the money back? How long did you wait and what was the amount?

Could you also tell me when you would have got the money back as, even i had been told that some people have allready got their refund?

I know you would not like to discuss this anymore, this dirty phase having gone by, but imagine what we are going through...if you advise us on how to get our money back it would be very kind of you...Hoping you would help
The legal tussle of the property has been going on since 2004, and still they got customers like me post that...is it possible that they are still getting customers??????????????????????????...

Then they are really adding to the tortured lot...this mugh become a scheme like the MAXWORTH ORCHARDS on which the supreme court had to grill the fraudsters.

Guys/People/Friends can we meet up and decide...before it gets too late...lets go and meet the SP of the area or the police commissioner or whatever it takes
LIMITATION PERIOD

The District Forum, the State Commission or the National Commission shall not admit a complaint unless it is filed within two years from the date on which cause of action has arisen.

PROCEDURE FOR FILING COMPLAINT WITH HELP OF ICRPC

1) Send your complaint (there is no format) addressed to us (by post / courier) duly signed stating facts date wise.

2) Mention the full name and address of the Opposite Party.

3) Your complaint should refer the attached documents where ever required (like bill, agreement, service report, etc). We will not search your documents and establish reference in complaint.

4) Enclose only the xerox copies of supporting documents. Don't send originals. Don't send documents by e-mail attachments.

5) Enclose your one year membership subscription of Rs. 225 by draft in favour of "ICRPC" payable at "Thane". Local Mumbai / Thane cheques also acceptable if drawn on Mumbai / Thane account.

6) Online payment through internet banking is also available, send a request e-mail for procedure.

7) State your name, address, residence. telephone no., profession, and date of birth in a separate sheet of paper attached with your complaint letter.

8) Mention your e-mail address (this is important). Without it you will not receive the copy of notice.

PROCEDURE THAT WILL BE FOLLOWED BY ICRPC AFTER RECEIVING YOUR DOCUMENTS:

1) After the receipt of your documents, ICRPC will issue a legal notice (within 10 days) to the accused giving him a time limit of 7 to 15 days for settling your grievance. Please do not waste our time by calling us just for checking whether we have received your documents.

2) If you do not hear from us or receive a notice copy within 20 days after you sent documents to us, write a reminder e-mail.

3) If your grievance is not settled after sending notice, ICRPC shall further help you to file a consumer complaint in the consumer court. Please remind us by e-mail, for further action after the expiry of the time given in notice to the Opposite Party.



PROCEDURE IF THE GRIEVANCE IS NOT SETTLED THROUGH NOTICE

1) Ask us for the procedure for filing a case against the company after they do not settle your grievance through our notice.

2) We charge a very nominal fee for preparing the case papers for you. We suggest that you get the case papers made through professional and experienced hands as this will reflect your case technically better and with precision.

3) You will not require a lawyer as we give free guidance to members till the end of their consumer case. Remember that you can explain you case better than anyone else.



OTHER USEFUL INFORMATION

1) We operate through the internet, e-mail, and cater to the consumers across the world. So, it does not matter where you are located.

2) Please do not visit us without appointment as we will not meet you. Please do not telephone us for unnecessary discussions as we are highly busy throughout the day handling 200 to 300 complaints everyday.

3) For members one legal notice is sent free for the first case.

4) For further cases by same member, a processing fee of Rs. 200 is charged per case during their membership tenure. One year membership can be renewed anytime by paying Rs. 225.

5) Consumer courts take about 1 to 2 years (or even more at times) to settle the case. The consumer is expected to attend the court hearings at least 5 times in a year.

General Procedure of Consumer Complaint

1. Send a notice to the Opposite Party giving him time limit to settle your grievance.

2. Prepare the consumer complaint in the required format (as also given in this web-site)

3. Get the complaint affidavit notarized through a notary.

4. Make required number of photocopies after notarizing.

5. Prepare a bank draft from a nationalized bank to pay court fee.

6. Submit the complaint and court fee to the receiving clerk in the consumer court who will give you the date for admission hearing and complaint reference number number.

7. On admission hearing, you would be informed whether your case is fit for acceptance or not. If accepted, you will be given the date for next hearing.

8. The court will send your complaint copy to the opposite party seeking reply within 30 days, and asking him to attend the hearing.

9. The hearings will continue till the matter is decided.

10. The courts final order will be sent to all the parties by registered post.

Please note: It is important to attend the hearings, else the matter may be decided ex-party on the merits of the case.
the problem of limitation of two years is solved or taken care of for those people who received a letter from the builder saying they would be paid from 1st april-09 onwards

We need to gather in bhopal and file a complaiant agaianst him.This is not only Mr.Amit rathore business we need to trace out the broker people, without whom they cant reach to us.The complaianst should be against the whole peole involved into the transection either he is broker or staff.Actulally they are the people who hide all the truths and encourage us to put the money.We have booked it throru Allians estate(Mr.Narang is the person).we paid 55% (Rs.7 lakhs)of the total amount.

I am afraid that few person has expressed very good line in favour of Mr.Amit rathore.May i request them to have a contact info of them so that we can also learn to get our money back.This is absolute nonsense that they are making us fool from last 2-3 years and we are are not doing anything agaisnt them.Whoever has got the genuine information, My request is not to publish it in web or print so that our action palan is reached out the there people.we should unite in phone no or mobiles ans share the information.

i also recived a letter mentioned that they will return the money back april 2009 onwards and also enclosed the registrar letter-memorumdam letter mentioned that they ve formed a ltd company.

Hello All,

Thanks a lot for those who had been participating to do the investigations against the builder and who are on the email contact with me.

We are going to file individual complaints with the consumer forum in Delhi by next week. In case any one who is missed out and is interested in a legal action against the builder then you can get in touch with me.

I will request everyone to launch a complaint regarding this in EOW (Economic offence Wing). I and some other friends of mine have already submitted a request 2 weeks before there and EOW has assured an action on this.

Last week i have received a letter from amit Rathore in which his wording were like that he is very pissed of because people have given a complaint against him in EOW (which means he is approached by EOW just 1 week after filing the complaint). He was pleading that everyone should coperate with him and matter will get sought out. I tried to contact him but could not catch him.

I will suggest everyone please put your complaint in EOW, i think that is the only way of getting you money back.

All i can say is that our attitude towards getting our money is not one that would help us, we are not working in a concerted manner...besides, there seems lack o[censored]nity as well, all if which is helping Amit Rathore stay pretty.

Our being happy that he is communicating with us is ourbiggest pitfall...on the contrary, we should ensure more and more people get together in filing complaints...help others/coax them to file with the EOW...

I agree on the comments & fraud done by Max worth, as I ahve also applied for refund for oneof my client and no satisfactory replies received from the builder.
