I am writing this complaint against M3M smart world builders for their unfair practices, mental harassment and denial of refund booking amount.

I would like to highlight that I booked a 2.5 bhk flat through smart world developers in their smart world gems Sec 89 Gurgaon project on 23rd Nov 2021 by paying amount Rs. 7 Lakhs (2 Lakhs online transfer and 5 Lakhs through cheque no 664661) as 10% of the bsp of the flat (Payment proofs attached).
At the time of booking, I was promised that I will receive my allotment letter in next one week and no booking receipt was provided against my booking. Also, I was told that I can cancel my unit any time before BBA (Builder Buyer Agreement) and can receive refund of my full booking amount.
Since November I am continuously chasing the RM and channel Partner for my Allotment letter, however, didn't received any response.
After waiting for two months and continuously chasing them on emails and phone we decided to visit their sec 82 gallery office on 27 Jan 2021. We met our RM there and he told us that our unit is Frozen one and they cannot provide allotment for this until they get DDJAY approval for the same. However, he promised and assured us that we definitely get our allotment letter by 15th March 2022. Also, he scared us that our booking amount will be forfeited if we cancel our unit at this time.
We trust their assurance and promise and wait till 22nd march but didn't received any confirmation or allotment.
When we again visit their office on 22nd march, they provide us a new deadline of 15th April. Once again, we trust them as we don’t have any option other than waiting.
When we checked on 15th April again, our channel partner told us that he is not sure when we get allotment for our unit, and we sense same response by RM fake promise as well.
After 5 months waiting, a lot of harassment and observing fraudent behaviour of the Builder, we completely lost our trust on them. Finally we decided to cancel our unit and send a cancellation email to smart world CRM Team on their email id ([protected]@smartworlddevelopers.com) and asked for our full refund of money. However as expected, there was no response or acknowledgment on our cancellation email as well.
After waiting for almost 2 weeks, we visit smart world head office branch situated at sec 66 Gurgaon and asked for our refund, but they completely deny our request and told that they don’t have any cancellation or refund policy. When we asked for any such written statement or policy document, they asked us to wait for 48 hours. Now they are not refunding our amount neither they are acknowledging cancellation.

I would request you to registar legal complaint against them and help me to get my refund of booking amount. I am also planning to file a consumer case of fraud against them.
